1. Repair Service Terms & Minimum Fee
- Minimum Service Fee: All mail-in repair bookings are subject to a $75 minimum fee. This fee covers diagnostic time, professional assessment, and return shipping (P&P).
- Payment of Fee: The minimum fee is payable regardless of whether the device is repairable. It is credited toward the final cost if a repair quote is accepted.
- No Guarantee: Due to the nature of board-level electronics repair (especially following liquid damage or previous repair attempts), payment of the diagnostic fee does not guarantee a successful repair outcome.
2. Repairs & Shipping
- Data Integrity: We do not guarantee the safety of data. Customers must back up all critical files before shipping. Paul L Daniels is not liable for any data loss.
- Shipping Risk: We recommend using insured, signature-required post. We are not responsible for items lost or damaged in transit to or from our laboratory.
- Abandonment: Items left unpaid for more than 90 days after the final invoice or notification of completion will be considered abandoned and may be disposed of or sold to recover costs.
3. Limitation of Liability
To the maximum extent permitted by law, Paul L Daniels shall not be liable for any indirect, incidental, or consequential damages, including but not limited to: lost profits, loss of data, business interruption, or the cost of procurement of substitute goods.
4. Australian Consumer Law
Our services and goods come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures, you are entitled to a refund, replacement, or re-performance of the work. This represents the total limit of our liability regarding service and product failures, except where the ACL requires otherwise.
5. Software Licensing (FlexBV and related tools)
- Licence, not sale: Purchasing or downloading FlexBV (or other software distributed from this site) grants you a licence to use the software; it does not transfer ownership or intellectual property rights in the software itself.
- "As is" basis: The software is provided "as is," without warranty of any kind, express or implied, including but not limited to fitness for a particular purpose. You use it at your own risk, and Paul L Daniels is not liable for any loss, damage, or data issues arising from its use.
- Update checks: FlexBV checks for the latest available version on startup by default. This can be disabled in the application's settings. See the Privacy Policy for what this check does and does not transmit.
- No redistribution: Unless separately agreed in writing, you may not resell, sublicense, or redistribute the software.
- All sales final: Software licence purchases (including FlexBV) are final and non-refundable. Product pages, purchase checkboxes, and confirmation steps set this out explicitly before purchase, along with clarification that no boardview or schematic files are included with the software. This no-refund policy does not exclude any consumer guarantee that cannot be excluded under the Australian Consumer Law.
6. Shop & Physical Goods (ring lights, USB-C meters, parts)
- Checkout: Purchases are processed via PayPal. Order and shipping details are passed to us via PayPal's IPN system to fulfil your order — see the Privacy Policy for details.
- Returns & faults: If a product arrives faulty or not as described, contact us and we'll arrange a repair, replacement, or refund in line with the Australian Consumer Law guarantees above.
- Change of mind: Change-of-mind returns are not automatically accepted but may be considered on request; contact us before sending anything back.
- Shipping risk: As with repair returns, we recommend trackable/insured post for any returns sent to us. We are not responsible for return shipments lost or damaged in transit.
- Hardware use: Ring lights, USB-C meters, and similar tools are supplied for general bench/repair use; no fitness for a specific specialised application beyond their stated purpose is guaranteed.
7. General
